Delaware does not have any franchise registration laws and is considered a non-registration state. Franchisors interested in offering or selling franchises in Delaware do not need to register or file anything with the state of Delaware to begin selling. The FTC Franchise Rule is applicable and must be followed. Delaware does have the Delaware Franchise Security Act which does not contain franchise registration or franchise filing requirements. This law is enacted to provide protection for the relationship between the franchisee and seller franchisor.
